To me the straw man fallacy simply means creating a weaker version of another persons argument and attacking it as pictured above. A more formal description is presented below.
Straw Man Description:
The Straw Man fallacy is committed when a person simply ignores a person’s actual position and substitutes a distorted, exaggerated or misrepresented version of that position. This sort of “reasoning” has the following pattern:
1. Person A has position X.
2. Person B presents position Y (which is a distorted version of X). 3. Person B attacks position Y.
4. Therefore X is false/incorrect/flawed.
This sort of “reasoning” is fallacious because attacking a distorted version of a position simply does not constitute an attack on the position itself. One might as well expect an attack on a poor drawing of a person to hurt the person.
It seems like bureaucrats are obsessed with things like making sure everyone and everything fits into neat little pigeonholes. That they are obsessed with uniformity and order at all costs goes without saying, it also seems like they love to create special statuses. I don’t know why this is, perhaps some kind of leftover rationality that people are simply not created equal.
In a rational society this would mean that people would be allowed to go into whatever career of lifestyle they pleased. How boring would this planet be if everyone was a copy of one person. But we do not live in a rational society, and special legal statuses are just another weapon in the states eternal war on everyone.
Some special legal statuses are good for those who hold them, certain government officials, police and snitches are what I like to call justified sinners, people “allowed” to violate the nonaggression principle under our current laws. People allowed to use violence, lies and threats to get what they want to keep the whole scam going. I use the term justified sinner because it is the best such description of these people I have ever seen. I first heard about it from John Taylor Gatto’s ultimate history lesson, which I would strongly recommend to anyone. The term justified sinner comes from John Calvin’s work where he claimed that about ten percent of the population is chosen by god to reign over us. If memory serves, (I could be wrong) this also means that only those 10% get to go to heaven while the rest of us go to hell in Calvin’s original works. A rather jarring contrast to everything I have been told about Christianity.
But what I want to talk about is special statuses which are no fun, I imagine by now everyone has known someone who has either been prosecuted for a crime, or to a lesser degree, adjudicated as insane. If you know someone who has been successfully prosecuted you know that they are placed in a special netherworld where it is harder, if not impossible to get a job, purchase a firearm or do any number of other things. If you have been labeled as a sex offender, oh ye gods! I don’t want to stand up for pedophiles but if you are registered as such for some innocuous thing like being caught with a stash of porn when you were a teenager or were falsely accused of a sexual crime. Found innocent at trial but still had to register, well, I think that’s just not right.
I first heard of all this many years ago when I was talking to an odd fellow who I will call Scotty. He was a mechanic, mad inventor and an all around screwball. He was mostly harmless but over the years he had run afoul of the law. One of the things he stressed was that he spent more time in jail than he could have because he did not want to have to report to a parole officer once he got out. He hadn’t been in big trouble with the law for a long time when I met him.
I don’t imagine he could get away with living outside scrutinization nowadays, with prison overcrowding and mandatory sentencing. I have been told, I hope they were wrong, that in California that you are in the probation system for a year after you get out of the clink. Even if it is for a very minor nonviolent offense for which you spent maybe three days in jail.
When this sort of thing happens you are physically free, but you are not free. This is an excellent example of the illegitimacy of the state, especially as tens of thousands of paroled prisoners have immediately gone out and committed more heinous crimes than what they got thrown in the can for in the first place.
There are some who uphold this fractured system saying that thirteen year olds who are registered as sex criminals for stealing a kiss from a girl. Or convicted rapists going out and raping again the week after they are let out of the pokey, are just isolated excesses. This is a lie, and it has always been a lie, as long as the state exists we will have justified sinners and more importantly for much of the population we will also have people who have tracking numbers burned into their records, bedeviling their lives because of mistakes long past. While those who have already proven that they don’t care about anybody’s laws will illustrate that they still don’t care.
